These Terms and Conditions ("Terms") govern your use of the TheoryTest.online website and booking service. By placing an order with TheoryTest.online, you confirm that you have read, understood, and agree to be bound by these Terms.
Important: TheoryTest.online is an independent booking service. We are not affiliated with, endorsed by, or connected to the DVSA (Driver and Vehicle Standards Agency), the DVLA, or any UK government body. The DVSA administers and controls the official UK theory test.
1. About the Service
TheoryTest.online provides two separate products:
Theory test booking: £59.00 (one-time payment)
- We act as your booking agent and book your DVSA car theory test on your behalf using the personal details you provide
- This one-time fee covers the DVSA theory test fee (currently £23) and our booking and administration service. You will not be charged separately by the DVSA
Study platform and pass guarantee: £23/month, with a 30-day free trial
- Access to 900+ official DVSA practice questions, timed mock tests, hazard perception training, and progress tracking
- Pass guarantee: if you attend your theory test and do not pass, we will rebook it at no extra charge, for as long as your subscription remains active
- Your first 30 days are free. After that, £23/month billed monthly. Cancel any time from your dashboard
- If you cancel, your study access and pass guarantee remain active until the end of your current billing period, then stop
2. Eligibility
To use our service you must:
- Hold a valid UK provisional driving licence
- Be aged 17 or over at the time of your test
- Be a resident of Great Britain (England, Scotland, or Wales)
- Provide personal details that are accurate and exactly match your provisional driving licence
We reserve the right to cancel your order and issue a full refund if we determine you are not eligible to sit the DVSA theory test.
3. The Booking Service
When you place an order, you authorise TheoryTest.online to book a DVSA car theory test on your behalf. Please note:
- We will make every reasonable effort to book your test at your preferred test centre and on or near your preferred date and time, but we cannot guarantee a specific date, time, or centre. Test slot availability is determined entirely by the DVSA and is outside our control
- We aim to confirm your booking within 24 to 48 hours of your order. You will receive an email confirmation with your test date, time, and centre address
- If no slots are available at your preferred centre within a reasonable timeframe (14 days), we will contact you to discuss alternative centres or dates
- The DVSA theory test fee is included in the price you pay. You will not need to make any separate payment to the DVSA
- You are responsible for ensuring the personal details you provide are correct. Incorrect details (including wrong name, date of birth, or licence number) may result in the DVSA cancelling or invalidating your test. TheoryTest.online is not liable for any loss arising from inaccurate details provided by you
- You must bring valid photo ID (your provisional driving licence photocard) to your test. Failure to do so may result in being turned away, and the DVSA fee will not be refunded in that event
4. Unlimited Free Resit Policy
If you attend your DVSA theory test booked through TheoryTest.online and do not pass, we will book your resit at no extra charge. There is no limit on the number of resits. This guarantee is active during your 30-day free trial and while your subscription remains active. If you cancel your subscription, resit bookings will no longer be covered.
Guarantee activation: The pass guarantee activates once you have demonstrated readiness by achieving a pass score on at least one full mock test within the TheoryTest.online platform. This condition exists to ensure the guarantee protects customers who have genuinely prepared using the platform. Until a mock test pass is recorded on your account, resit bookings under this policy are not available.
What counts as a fail: You physically attend your booked test at the correct test centre on the correct date and time, and do not achieve a pass mark on either the multiple choice section, the hazard perception section, or both. An official DVSA failure notification (email or result slip) is required as proof. Resit requests will not be processed without this documentation.
Non-attendance (no-show): If you do not attend your booked test for any reason (including illness, transport issues, change of mind, or any other circumstance), this does not constitute a fail under this policy. No resit will be provided and no refund will be issued. You will need to make a new purchase to book a further test. No exceptions are made to this rule regardless of the reason for non-attendance.
How to request a resit:
- Email hello@theorytest.online within 30 days of your fail date with the subject line "Resit Request"
- Include your full name, the email address on your account, and your official DVSA theory test failure notification (the result email from DVSA or a clear photo of your result slip showing your name, test date, and result)
- Resit requests submitted without proof of failure will not be processed
- We will confirm your resit booking within 24 to 48 hours of your verified request, subject to slot availability at your centre
The unlimited resit policy does not cover:
- Non-attendance (no-show): if you do not attend your test for any reason, no resit or refund will be provided and a new purchase is required
- Tests cancelled by you before the test date: cancellations by you forfeit the DVSA fee and no resit is provided
- Tests cancelled by the DVSA (you will be rebooked at no charge in this case)
- Tests that were not originally booked through TheoryTest.online
- Tests invalidated by the DVSA due to incorrect personal details provided by you
- Resit requests submitted more than 30 days after the fail date
- Resit requests submitted without official DVSA failure documentation
- Tests other than the UK car theory test (e.g. motorcycle, lorry, or bus theory tests)
Each resit booking covers the DVSA theory test fee only. No additional cash refunds are issued under this policy. The resit policy applies to the original purchaser only and is non-transferable.
5. Your Responsibilities
- Provide accurate, complete personal details that exactly match your provisional driving licence
- Attend your booked test at the correct time, date, and location with valid photo ID
- Notify us promptly at hello@theorytest.online if you need to reschedule or cancel your test. Note that the DVSA requires at least 3 clear working days' notice to reschedule without forfeiting the test fee
- Keep your account details secure and not share access with others
6. Pricing and Payment
Theory test booking: £59.00 (one-time)
This one-time fee covers the DVSA theory test fee (currently £23) and our booking and administration service for booking your test on your behalf. You will not be charged separately by the DVSA. The total charged at checkout is £59.00.
Study platform subscription: £23/month, with a 30-day free trial
The study platform and the pass guarantee are provided through your subscription, not the booking fee. Your first 30 days are free; after that your subscription renews automatically at £23/month, charged monthly to the payment method used at checkout. You can cancel at any time from your dashboard. Your access continues until the end of your current billing period. There are no cancellation fees.
All prices are inclusive of VAT where applicable. Payment is processed securely by Stripe. We never store your card details.
7. Subscription Terms
Your subscription to the TheoryTest.online study platform is subject to the following terms:
- Free trial: Your first 30 days are free. No charge is made during the trial period
- Automatic renewal: After your free trial, your subscription renews automatically at £23/month unless you cancel before the trial ends
- Cancellation: You may cancel at any time from your account dashboard. Your access will continue until the end of your current billing period. We do not offer refunds for unused portions of a paid month
- Pass guarantee: The pass guarantee (unlimited free resits) is active only while your subscription is active. Cancelling your subscription deactivates the pass guarantee at the end of your current billing period
- Failed payments: If a payment fails, we will notify you by email and your subscription may be suspended. You can update your payment details from your dashboard
8. Refund Policy
- Before your test is booked: you may request a full refund of the £59 booking fee within 14 days of purchase, as long as we have not yet booked your test. Email hello@theorytest.online with your order details
- Once your test is booked: the £59 booking fee is non-refundable once we have booked your test, as the DVSA test fee within it is non-refundable and the booking work has been completed
- Incorrect details: if your test is cancelled or invalidated because you provided inaccurate personal details, no refund will be issued
- No-show: if you fail to attend your booked test, no refund will be issued and a new purchase will be required to rebook
- Subscription: the £23/month study subscription can be cancelled any time from your dashboard. We do not refund unused portions of a paid month (see section 7)

9. Study Platform
Access to the TheoryTest.online study platform is included during your free trial and for as long as your subscription remains active. If you cancel your subscription, access will continue until the end of your current billing period, after which your account will be deactivated.
Practice questions are based on the official DVSA question bank. While we make every effort to keep content accurate and current, we cannot guarantee that questions reflect any future changes made by the DVSA to the question bank or Highway Code. The DVSA may update test content at any time without notice.
Your account is for your personal use only. You may not share login credentials or allow others to access your account.
10. Data and Privacy
To book your DVSA theory test, we must share your personal details (name, date of birth, driving licence number) with the DVSA via their booking system. By placing an order, you authorise us to use your details for this purpose.
We process your personal data in accordance with UK GDPR and the Data Protection Act 2018. Full details of how we collect, use, and protect your data are set out in our Privacy Policy.
11. Limitation of Liability
To the fullest extent permitted by law:
- TheoryTest.online is not liable for any indirect, incidental, or consequential losses arising from your use of our service
- Our total liability to you shall not exceed the total amount you have paid us under these Terms, including both the one-time booking fee and any subscription payments made prior to the event giving rise to the claim
- We are not responsible for DVSA decisions, test slot availability, test centre closures, changes to the DVSA theory test format or content, or any other matter outside our control
- We are not responsible for any loss arising from inaccurate personal details provided by you, including where the DVSA cancels or invalidates your test as a result
- We are not liable for any loss of earnings, travel costs, or other expenses incurred in attending your test
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under the law of England and Wales.
12. Complaints and Dispute Resolution
If you have a complaint about our service, please contact us in the first instance:
We will acknowledge your complaint within 2 working days and aim to resolve it within 14 days.
If we are unable to resolve your complaint to your satisfaction, you may seek assistance from the following free services:
- Citizens Advice Consumer Service: citizensadvice.org.uk or telephone 0808 223 1133
- Trading Standards: via your local council or through Citizens Advice
We are not currently a member of an approved Alternative Dispute Resolution (ADR) scheme. If that changes, we will update this section accordingly. Nothing in this clause affects your statutory rights as a consumer.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of our service will be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to These Terms
We may update these Terms from time to time. Changes will be published on this page with an updated "Last updated" date. Your continued use of our service after changes are posted constitutes your acceptance of the updated Terms. We will not retroactively change the terms applicable to orders already placed.
