These Terms and Conditions ("Terms") govern your use of the TheoryTest.online website and services. By purchasing from or using TheoryTest.online, you agree to be bound by these Terms. Please read them carefully before making a purchase.

1. About the Service

TheoryTest.online provides three core services:

  • Theory test booking: We act as a booking agent and book your DVSA theory test on your behalf using the details you provide
  • Study platform: Access to 900+ official DVSA practice questions, timed mock tests, and category drills
  • Pass Protection Guarantee: A conditional refund of the DVSA theory test fee if you fail your test after meeting the qualifying criteria

TheoryTest.online is not affiliated with or endorsed by the DVSA (Driver and Vehicle Standards Agency) or the DVLA (Driver and Vehicle Licensing Agency). The DVSA theory test fee is a government charge payable directly through the DVSA booking system.

2. Eligibility

To use our booking service, you must:

  • Be eligible to take the UK car theory test (hold a valid UK provisional driving licence and be aged 17 or over)
  • Provide accurate personal details exactly as they appear on your provisional driving licence
  • Be a resident of Great Britain (England, Scotland, or Wales)

We reserve the right to cancel your order and issue a full refund if we determine that you are not eligible to take the theory test.

3. The Booking Service

When you purchase our service, you authorise us to book a DVSA theory test on your behalf using the details you have provided. Please note:

  • We will make every effort to book your test at your preferred centre on or near your preferred date, but we cannot guarantee a specific date, time, or centre
  • Test slot availability is determined entirely by the DVSA and is outside our control
  • We aim to confirm your booking within 24-48 hours of your order. You will receive an email with your confirmed test date, time, and centre
  • If no slots are available at your preferred centre within a reasonable timeframe, we will contact you to discuss alternatives
  • The £23 DVSA theory test fee is included in the price you pay. You will not need to pay anything directly to the DVSA
  • You must provide valid, accurate personal details. Incorrect details (e.g. wrong licence number or date of birth) may result in your test being cancelled by the DVSA and no refund will be issued for the DVSA fee

4. Pass Protection Guarantee

To qualify for the Pass Protection Guarantee, you must: (1) complete at least 10 full mock tests on the TheoryTest.online platform with an average score of 90% or above; (2) take your DVSA theory test within 30 days of your confirmed booking date; and (3) fail your test.

If all three conditions are met, we will refund the DVSA theory test fee (£23 at the time of writing) to your original payment method within 5 working days of receiving proof of failure.

To claim a refund under the guarantee:

  • Email hello@theorytest.online within 7 days of your test date
  • Include a copy of your DVSA theory test failure notification
  • Your account must show at least 10 completed mock tests with 90%+ average at the time of your test

The guarantee does not cover:

  • Failure to attend your booked test (no-show)
  • Tests cancelled, rescheduled, or sat more than 30 days after the original booking date
  • Cases where fewer than 10 qualifying mock tests (90%+) were completed before the test date
  • The service fee above the DVSA test fee (i.e. we refund £23, not the full £54.99)

5. Pricing and Payment

The current price for our service is £54.99, which includes the DVSA theory test fee (£23), study platform access, and the Pass Protection Guarantee. All prices are inclusive of VAT where applicable.

Payment is processed securely by Stripe. We accept all major debit and credit cards. We never store your payment card details.

6. Refund Policy

We want you to be satisfied with your purchase. Our refund policy is:

  • Full refund: If you request a refund within 14 days of purchase, and we have not yet booked your test, and you have not started any mock tests on the platform, we will issue a full refund within 5 working days
  • No refund after booking: Once your DVSA theory test has been booked, the DVSA test fee (£23) is non-refundable. You will remain entitled to the Pass Protection Guarantee and full platform access
  • Partial refund: If your test has been booked but you have not yet used the study platform, we may offer a partial refund at our discretion — contact us to discuss your circumstances

7. Study Platform

Access to the TheoryTest.online study platform is included with your purchase and does not expire. You may use the platform for as long as you need it.

The practice questions on our platform are based on the official DVSA question bank. While we make every effort to keep questions accurate and up to date, we cannot guarantee that they reflect any recent changes to the DVSA question bank or Highway Code. The DVSA may change the real test questions at any time.

You may not share your account credentials with others. Each account is for a single user only.

8. Intellectual Property

All content on this website, including the design, text, and platform interface, is owned by or licensed to TheoryTest.online. The DVSA practice questions are adapted from publicly available DVSA materials. You may not copy, reproduce, or redistribute any content from this website without our prior written permission.

9. Limitation of Liability

To the fullest extent permitted by law:

  • TheoryTest.online is not liable for any indirect, incidental, or consequential losses arising from your use of our service
  • Our total liability to you in connection with any order shall not exceed the amount you paid for that order
  • We are not responsible for DVSA decisions, slot availability, or any changes to the DVSA theory test format or content
  • We are not responsible for any losses arising from you providing inaccurate personal details

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of our service will be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date. Continued use of the service after changes are posted constitutes acceptance of the updated Terms.
